What actually decides whether you can build a suite above your garage?

Almost every constraint here is municipal rather than national. Whether a secondary or accessory dwelling unit is permitted at all, how large it may be, how many parking spaces the property must keep, and how close the structure can sit to the property line are all set by your local zoning bylaw, and they differ between neighbouring municipalities. What the structure has to do differently

A garage roof carries snow and its own weight. A floor above a garage carries people, furniture and partitions, which is a different and larger load, applied differently. That means the framing, the wall support beneath it and the foundation all have to be designed for occupancy from the start. Retrofitting occupancy onto a shell that was engineered for storage is expensive and sometimes not possible, so this belongs in the first conversation, not the third.

Stairs, access and getting out

Stairs consume more floor area than people expect, and where they land affects both storeys. An interior stair eats garage floor space and needs headroom above; an exterior stair keeps the parking clear but has to work in winter and be sheltered from ice. Any space used as a dwelling also has its own means-of-egress requirements, and those are enforced locally. Decide the stair position early, because it is the hardest thing to move later.

Servicing, separation and comfort

A habitable space above a garage needs heat, ventilation, power and, if it is a dwelling, water and drainage. It also needs a rated separation between the garage and the space above, because vehicle exhaust and stored fuels sit directly below. Insulation and air sealing matter more here than in a plain garage, both for comfort and because the floor is exposed to an unheated space.
